Is your art really safe?


When was the last time you used an image-hosting website such as Tinypic, so that you could put your art into your den, or put up your avatar?

Sadly, if you're using sites like this, it's important to read their terms and conditions!

Please do NOT use Tinypic unless you have no problem with giving up the copyright and ownership to your art in exchange for their service!

"TinyPic does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, "Content") that you post on or through the TinyPic Services. By displaying or publishing ("posting") any Content on or through the TinyPic Services, you hereby grant to TinyPic and other users a non-exclusive, fully paid and royalty-free, worldwide, limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate such Content, including without limitation distributing part or all of the Site in any media formats through any media channels. Content will be publicly available, and TinyPic and other Users may copy or display Content outside of the TinyPic Services through the quick link feature or through any other display mechanisms."

What I'm going to do is begin populating two lists; a RED and a GREEN list, so that artists know which sites to avoid, and know how they can keep the rights to their work. Everyone is welcome to contribute! Please feel free to post!


The GREEN list : Your art is okay!

The RED list : Potentially unsafe!


It's pretty easy to find out if a hosting site is good or not; scroll down and look for Terms and Conditions, or just Terms. Scan through the tl;dr and look for something similar to the tinypic example.

From the Photobucket privacy settings page:

Private Albums

When an album is private:

Photos and videos in the album do not display in Photobucket search results.
Your followers will not see photos uploaded to the album.
You will not see images you upload to the album on your Profile page.
You may share without allowing viewers access to the entire album.


You should be fine! :)

From Imgur's TOS:

With regard to any file or content you upload to the public portions of our site, you grant Imgur a non-exclusive, royalty- free, perpetual, irrevocable worldwide license (with sublicense and assignment rights) to use, to display online and in any present or future media, to create derivative works of, to allow downloads of, and/or distribute any such file or content. To the extent that you delete any such file or content from the public portions of our site, the license you grant to Imgur pursuant to the preceding sentence will automatically terminate, but will not be revoked with respect to any file or content Imgur has already copied and sublicensed or designated for sublicense. Also, of course, anything you post to a public portion of our site may be used by the public pursuant to the following paragraph even after you delete it.

So basically, if you delete it, people can still make derivative works of things you made, or otherwise use them :/ That being said 'derivative work' does imply giving credit to the original artist, and Imgur is pretty good about deleting stolen content.

Re: Tinypic, it messes up reverse image searching, which I use to check that people aren't stealing art examples from someone, and I get immediately suspicious when it's used, as I've busted several art thieves on here that used tinypic.
